Little Airline Terms of Service

These terms are an agreement between you and Now On Company Limited, 112/246 Srinakarin, Samut Prakan 10540, Thailand (Thai company registration number 0115564023284) ("we", "us"), the publisher of the Little Airline app ("the Game"). By installing or playing the Game you agree to them. If you do not agree, do not use the Game.

If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. The Game is meant for players aged 12 and over.

Nothing in these terms takes away rights you have as a consumer under the law of the country where you live. Where a sentence below says "to the extent permitted by law", it means exactly that: it applies only as far as your local law allows.

1. What you get: a licence, not ownership

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install the Game on Apple devices you own or control, and to play it for your own non-commercial entertainment, under these terms and Apple's Usage Rules in the App Store terms.

You do not own the Game or anything in it. That includes airlines, aircraft, routes, saves, levels, badges, titles, paint schemes and other cosmetics, crate rewards, leaderboard positions, and any content or mode you pay for (together, "Game Content"). Game Content has no monetary value, cannot be exchanged for money, and cannot be sold, transferred, traded or gifted except through a feature Apple provides, such as Family Sharing where we have turned it on.

We, and our licensors, keep all rights in the Game and Game Content that these terms do not expressly grant you.

2. Purchases

The Game is free to download and free to play to the end. Some optional extras, such as separate game modes, can be bought inside the app. Every purchase is made through Apple's in-app purchase system. Apple takes the payment, and Apple's terms apply to it. We never see your card or payment details.

What a purchase buys. A purchase buys a licence to use that Game Content under these terms, not ownership of it. It is not a deposit, does not create a balance, and cannot be redeemed for cash.

Refunds. Refund requests for in-app purchases are decided by Apple under Apple's own terms (reportaproblem.apple.com). Except as required by law or by Apple's terms, purchases are final and we do not give refunds ourselves. If you live in the European Union, the United Kingdom or another place with a legal right to cancel or to a remedy for faulty digital content, those rights still apply and nothing in these terms limits them.

Restore. You can restore non-consumable purchases on another device signed in to the same Apple Account, using "Restore purchases" in Settings. A purchase does not need a Little Airline account.

Refunded or reversed purchases. If Apple refunds or reverses a purchase, we may remove the Game Content it unlocked.

Prices and availability are set in the App Store and may change. Changing a price never changes what you already bought.

3. Free reward crates

Some airline levels earn a free reward crate holding a cosmetic item. Crates cannot be bought, are never sold, and have no monetary value. The chance of each kind of item is shown on the crate. What a crate holds is fixed when it is earned.

4. Accounts

You can play the whole Game without an account. If you choose to sign in with Apple or Google, you get save backup and online features such as the leaderboard and friends leagues.

You are responsible for your Apple or Google account and for what happens through it. You can delete your Little Airline account at any time in Settings. Deleting it removes your online data as our Privacy Policy describes, and does not delete the Game or the saves on your device.

5. Online features

The leaderboard and friends leagues show a generated player name (for example "Silver Heron 41") and your results, never your real name or anything you typed. A friends league's creator chooses its settings, and everyone in that league plays under them.

You agree not to cheat on any shared surface: no modified clients, edited saves, automated play or exploited bugs to post results. We may remove entries we believe were not earned in normal play, and we may suspend online features for an account that does this repeatedly.

6. Rules of use

You must not, except as the law expressly allows: copy, sell, rent or sublicense the Game; reverse engineer, decompile or disassemble it; interfere with our servers or other players; use the Game for anything unlawful; or remove any notice of ownership.

7. No guarantee of continued service

The Game is designed to be played offline, and the main game does not depend on our servers. Even so, to the extent permitted by law:

Ending a feature or the Game does not by itself entitle you to a refund, except where the law or Apple's terms say otherwise.

8. Ending these terms

You can stop at any time by deleting the Game and, if you have one, your account. We may suspend or end your licence or account if you seriously or repeatedly break these terms. Sections 1, 6, 9, 10, 11 and 12 survive the end of these terms.

9. Warranty

To the extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, and without any promise that it is free of errors or that saves cannot be lost. Keep the backups the Game offers if your saves matter to you.

If you are a consumer in the EU, the UK or another place that gives you legal guarantees for digital content, those guarantees still apply.

10. Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, saves, progress or Game Content, and our total liability to you for any claim about the Game is limited to the greater of what you paid us for the Game in the 12 months before the claim and USD 50 (or EUR 50 where the euro applies).

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or (in the EU and UK) for gross negligence or intent, or your statutory rights as a consumer.

11. Apple

These terms are between you and us, not Apple. Apple is not responsible for the Game or its content. Apple has no duty to provide maintenance or support for it. If the Game fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any; to the extent permitted by law Apple has no other warranty obligation. Apple is not responsible for any claims about the Game, including product liability, failure to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that the Game infringes someone's intellectual property; we are responsible for those to the extent these terms do not disclaim them. You confirm you are not in a country subject to a U.S. Government embargo and are not on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Law and disputes

These terms are governed by the law of Thailand. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts there.

13. Changes to these terms

We may update these terms. We will show a notice in the Game before a material change takes effect. If you keep playing after it takes effect, the new terms apply; if you do not agree, stop using the Game and delete your account. A change never takes away a purchase you already made.
